PETALING JAYA: Three lawyers have dismissed former law minister Zaid Ibrahim’s suggestion for opposition leader Hamzah Zainudin to move a parliamentary motion extending Chief Justice Tengku Maimun Tuan Mat’s tenure by five years.
Constitutional lawyer Bastian Pius Vendargon stated the proposal conflicts with Article 125 of the Federal Constitution, which mandates a retirement age of 66 for Federal Court judges. While the Yang di-Pertuan Agong can grant a six-month extension, Vendargon emphasized that bypassing the king and prime minister’s roles would render the move unconstitutional.
Former Malaysian Bar president Salim Bashir agreed, stating Parliament has no authority in judge appointments. Lawyer Philip Koh noted historical controversy over similar extensions, referencing former Chief Justice Raus Shariff’s extended tenure, which faced legal criticism.
The Judicial Appointments Commission (JAC) should oversee discussions on judge appointments and tenure extensions, said Vendargon, ensuring the process remains free from executive interference. Tengku Maimun is set to retire in July this year.
